We have started off the year being notified that a trial date has been set for the Little Pond case. The trial will begin on May 27, 2008. This will be an opportunity for all the facts to be heard. All interested parties are welcome to attend the trial at Barnstable Superior Court, Route 6A, Barnstable, MA.

At the request of the defendant, Little Pond LLC, the trial has been continued until sometime in the fall, perhaps September.
December 1, 2008
Two (2) years after original ENF application is withdrawn, the developer’s engineering firm re-files a second ENF to the Massachusetts Executive Office of Energy and Environmental Affairs (EOEA – formerly known as MEPA). Substantive change – developer proposes to redirect and treat (at the Little Pond development site) an additional 8,000 gallons of daily effluent from the adjacent Falmouth Trade Center business location. This is their proposed mitigation plan to achieve a “zero net nitrogen” output into Little Pond. Public comments due by December 30, 2008, decision due by January 9, 2009.
