It has been a pretty quiet winter for the Save Little Pond group. Last December, the applicant in the Little Pond Landing appeal appeared before a Boston judge and was extensively questioned by the attorney for the LPL project regarding how the construction would be detrimental to him. An attorney and engineering consultants were hired to reinforce the arguments of the applicant. The attorney for the LPL project filed a motion to dismiss stating testimony did not show that the applicant would not be directly affected by the construction of the project. It was only recently that we heard a decision by the judge would be forthcoming. The question stands, will he allow the case to move forward or will he dismiss the case.

In addition to the start of the appeal, the DEP's review of the Little Pond Landing project last year resulted in what would be the very likely issuance of a 'no net nitrogen' (NNN) permit being issued to the project, as it currently was proposed. A NNN permit would require the developer to remove any nitrogen from the pond that the project would produce. One way this could be done would be to provide waste water treatment to some of the surrounding homes. Shortly after this news, the engineer for the project withdrew the Environmental Notification Form (ENF) and apparently has gone back to the drawing board. We anticipate that we will be seeing a new ENF in the near future.
